The hearing board in this attorney disciplinary proceeding concluded that the respondent violated the Code of Professional Responsibility and recommended that he receive a private censure. A hearing panel of the Supreme Court Grievance Committee approved the boards findings and recommendation. The assistant disciplinary counsel has excepted to the recommended discipline as too lenient, and the respondent contends that the complaint should have been dismissed. We approve the boards findings, but conclude that a public censure is appropriate given the seriousness of the misconduct.
